terms and conditions: SWATCH X YOU – SWATCH CALLING

  1. These terms and conditions (“the Rules”) govern the project „Swatch X You – the World is calling“ (“the Project”) administered by Swatch Ltd., domiciled at Nicolas G. Hayek Strasse 1, 2502 Biel-Bienne, Switzerland („Swatch“, “us”, “our”, “we”).

  1. Brief description of the Project:

    1. Each week during the Expo 2020 in Dubai, one or several countries will be celebrated. Swatch, as Official Partner of the Expo 2020, will take part in these celebrations by giving its customers, during this time only, the opportunity to print a customized watch based on an artwork inspired by the country in question. 

    2. Artists from all over the world (“Artists”, “you”) are invited, by an online call on Swatch’s website (www.swatch.com) to submit an artwork to celebrate their own country and to be used for print customized watches. Out of these, Swatch will select only one artwork for each country.

  1. By submitting an artwork under this Project, you agree to comply with and be bound by these Rules and in particular to transfer all copyrights to your artwork to Swatch if it is selected.

  1. You may only submit an artwork for a certain country if you are a citizen of that country. Further, you may only participate if you are an individual aged 18 or over, not under custodianship and not an employee of a Swatch Group company. Submission by legal entities will not be considered. By submitting an artwork, you confirm that you fulfill these conditions. We reserve the right to request evidence that these conditions are fulfilled (in particular ID card or passport copy) and/ to make exceptions on a case by case basis, at our sole discretion.

  1. You have to submit the artwork, together with your complete name and Country you represent as well as the artwork title, until midnight CET on 22 August 2021, in high-resolution JPEG by email to swatch.calling@swatch.com. Incomplete, late, or otherwise faulty participations will not be accepted. You can only participate once and with only one artwork. 

    All artworks must be fully executed, in format .ai or open PDF, artboard in size 420x420mm – in case of an image, we need 420x420mm in 600 DPI’s – please DO NOT work with RGB color setting.

  1. For the case that your artwork is selected, you agree to provide a good quality picture of yourself, your first and last name and your biography, to be used by us as  presentation and in promotion of the Project, incl. worldwide on Swatch’s website. You also agree to provide your address and proof of identity (ID or passport copy). Failure to provide these information may lead to disqualification from the Project at our sole discretion. We will only use this information for the purpose of realization of the Project and in accordance with our Privacy Policy (https://www.swatch.com/en-gb/legal/swatch-legal-privacy-policy.html).

  1. The selection of the artwork is at Swatch’s sole and absolute discretion and no reason will be provided for non-selection. The selected Artist will be notified via email until 9 September 2021.

  1. Even if you follow these rules and instructions correctly, the possibility of events or conditions beyond our control means that we cannot guarantee your successful participation. The provision of any invalid, incorrect, or misleading personal information, and any breach of the Rules may, in our sole discretion, lead to disqualification from the Project and/or from receipt of any compensation.

  1. Each Artist agrees that if the artwork she or he submitted is selected, she or he will sign, within five (5) days from the selection, an Assignment Letter to assign all copyrights to the selected artwork to us, allow Swatch to use his name, biography and picture in promotion of the Project, for the consideration mentioned in Section 12 below. If an Artist does not sign such Assignment Letter on time, Swatch may at its sole discretion disqualify him/her and select a different artwork.

  1. You warrant and guarantee that the artwork submitted to us is your original artwork, and not copied partially or wholly from any third party design (regardless whether such other designs are under intellectual property rights registration or not). You guarantee furthermore that the artwork does not infringe any applicable law. Artworks with offensive, vulgar, pornographic, racist, polemic or otherwise abusive content will not be considered in the selection process.

  1. You agree to indemnify and hold us harmless against any and all damages, losses and expenses (incl. legal costs and attorney’s fees) arising out or in connection with any claim raised by any third party in relation to the artwork provided to us by you, in particular any claim that your artwork or its use in the Project infringes such third party’s intellectual property rights such as trademark, copyright, design or patent.

  1. Within 30 days from signing the Assignment Letter, the selected Artist will receive CHF 351 (three hundred fifty-one Swiss Francs) as symbolic thank you compensation, provided that the Artist has timely provided full details of a bank account in his/her own name. Any applicable banking fees, currency exchange costs and taxes will be at the Artist’s charge. In addition, and, as soon as practicable after the Artist’s artwork has been made available to customers, Artist will receive seven (7) Swatch wristwatches printed based on their own Artwork, provided that the sending can be done at reasonable costs.

  1. The right to claim the prize may not be assigned to anyone other than the author of the selected artwork. No alternative prizes are available. We reserve the right, in our sole discretion, to substitute the compensation with items of equal value.

  1. Artists whose artworks are not selected will receive no compensation and Swatch will not use their artworks or information in relation with the Project. Swatch may however retain a copy of the artwork and the Artist’s name for the time of applicable statutes of limitations.

  1. Any taxes that may be levied on the selected Artist in relation with the Project shall be exclusively borne by her/him/it. The Artist is responsible for payment of any social security contributions in relation with the Project.

  1. Any decisions by us regarding the Project are final and no correspondence will be entered into. The selection of the artworks is at our sole discretion.

  1. We and our affiliates disclaim all liability, to the greatest extent legally permissible, for any damage suffered by anyone as a result of or in connection with the Contest.

  1. We reserve the right to cancel or delay the Project and the provision of compensation due to Force majeure without liability. Force majeure is any radical, external event beyond the control of the affected party such as, by way of example but in no way exhaustive, natural disasters, war, riots, revolts, insurrections, strikes, pandemics and government measures related to the same.  

  1. The Rules are governed by and will be construed in accordance with the laws of Switzerland, without regard to any conflict-of-law rules. Any disputes in relation with the Project are subject to the exclusive jurisdiction of the courts in Biel/Bienne, Switzerland.
